RYGAARD CREATIONS STORE - OFFICIAL DIGITAL PRODUCTS REFUND POLICY

Please read this Refund Policy carefully before purchasing any digital assets, including but not limited to Rygaard Brushes packs, individual brush files, presets, brush tips ("known as alphas") or associated digital contents ("Products"), under any available license tier (Individual Commercial or Studio Commercial Tiers).

By completing your purchase on our Payhip storefront, you and your organization expressly acknowledge, understand, and agree to be bound by the terms and conditions outlined below.

1 - STRICT "ALL SALES ARE FINAL" POLICY

1.1. ABSOLUTE NON-REFUNDABILITY:

Due to the intangible, irreplaceable, instantly reproducible, and digital nature of our assets, RYGAARD CREATIONS Store enforces a strict, absolute, and uncompromising NO REFUND, NO RETURN, and NO EXCHANGE policy. Once a transaction is completed and payment is processed, it cannot be canceled, reversed, modified, or refunded under any circumstances.

1.2. IMMEDIATE CONSUMPTION AND DELIVERY:

All digital products (including but not limited to .3dcpack, .penpack, .3b, .obj, .fbx, .gltf / .glb, .dae, .stl / .ply, .3ds, .psd, .png, .tga, .tiff / .tif, .exr / .hdr, or compressed .zip / .rar formats) are delivered instantly via automated download links upon successful payment processing through PayPal, Stripe, or associated gateways. The generation of the post-purchase download page or the dispatch of the automated fulfillment email constitutes complete and definitive delivery of service.

1.3. PRODUCT "UNSEALING" AND ACCESS:

In accordance with international digital commerce legislation, clicking the "Download" button, generating a download token, accessing the product files via a direct link, or using the "Add to Account" feature within the Payhip member area constitutes the official "unsealing" and full consumption of the digital goods. Once unsealed, the product cannot be physically or digitally "returned" or restricted from the buyer's local storage, making refunds physically, technically, and legally impossible.

1.4. EXCLUSIONS FROM REFUNDS:

For the absolute avoidance of doubt, refunds, store credits, or product exchanges will NOT be granted under any condition for reasons including, but not limited to:

• Buyer's remorse, change of mind, internal team restructuring, or a pivot in project/production requirements.
• Accidental purchases, double-purchases, or purchasing the wrong quantity/license tier.
• Software or hardware incompatibility (e.g., attempting to use the assets on unsupported software, outdated 3DCoat versions, or third-party programs instead of meeting the software requirements clearly specified on the product description page).
• Third-party platform or network infrastructure issues (e.g., buyer's local internet connectivity failure, local firewall restrictions, or temporary ISP routing issues).
• Lack of technical skill, hardware limitations, or failure to read the comprehensive product description prior to checkout.
• Dissatisfaction with artistic style, brush behavior, or performance effects.

2 - INTERNATIONAL & DOMESTIC STATUTORY CONSUMER RIGHTS NOTICE

2.1. BRAZILIAN CONSUMER NOTICE (EXPLICIT WAIVER OF RIGHT OF REGRET):

If you are a consumer operating or residing within the territory of Brazil, you acknowledge that under Article 49 of the Brazilian Consumer Defense Code (Law No. 8.078/90 - CDC), a 7-day cooling-off period ("direito de arrependimento") applies to standard remote commercial transactions. HOWEVER, due to the immediate delivery, unsealable nature, and instant execution of digital content, you HEREBY EXPLICITLY ACKNOWLEDGE, CONSENT, AND AGREE on behalf of yourself or your organization that by initiating the download process, clicking the download link, or clicking "ADD TO ACCOUNT," you are requesting the immediate execution of this contract. You expressly agree that once execution has begun, you fully, irrevocably lose and waive any statutory right to withdrawal, regret, cooling-off periods, or refund under the CDC.

2.2. EU & UK CONSUMER NOTICE (DIGITAL CONTENT RIGHTS EXCLUSION):

For customers residing within the European Union (EU) or the United Kingdom (UK), under the Consumer Rights Directive and local Consumer Contracts Regulations, the 14-day statutory right of withdrawal is completely excluded for digital content delivered instantly. By completing your purchase, you give your express explicit consent for the immediate provision of the digital content and acknowledge that you lose your statutory right to cancel the transaction once the download link has been generated, dispatched, or accessed.

3 - NO EXCHANGES, UPGRADES, OR PARTIAL CREDITS

3.1. STRICT VARIANT COUPLING:

Every license tier sold on this store (Individual Commercial, Studio 1-4 Users, Studio 5-9 Users, and Studio 10+ Users) is treated as an independent, distinct digital asset product SKU.

3.2. NO PAY-THE-DIFFERENCE UPGRADES:

If you mistakenly purchase an Individual License instead of a Studio License, or if your team expands post-purchase, our store system cannot issue partial credits, partial refunds, or "pay-the-difference" tier upgrades.

3.3. CHECK YOUR VERSION AND BUILD NUMBER:

It is the buyer's sole responsibility to verify that their installed software version and build number matches the technical requirements listed under their selected variant.

3.4. RE-PURCHASE REQUIREMENT:

To legally utilize the assets under a different operational tier, you must purchase a completely new, separate, and standalone license variant that fits your current team size. Your original payment cannot be applied as credit toward the new purchase, and the original transaction remains strictly non-refundable and tied to its original terms.

4 - FRAUDULENT CHARGEBACKS, REVERSALS, AND DISPUTES

4.1. DEFINITION OF CHARGEBACK FRAUD:

A chargeback, payment dispute, or reversal request filed through your credit card issuer, banking institution, PayPal, or Stripe after a digital file or download link has been delivered and accessed is considered an act of digital theft, unauthorized licensing breach, and bad-faith fraud ("Friendly Fraud").

4.2. AUTOMATIC LICENSE REVOCATION & COPYRIGHT INFRINGEMENT:

Filing a dispute, chargeback, or "unrecognized charge" claim through PayPal, Stripe, or any bank will result in the IMMEDIATE, AUTOMATIC, and PERMANENT revocation of your commercial license (whether Individual Commercial or any Studio Tier). Upon filing, you and your company must instantly cease all use of the Rygaard Brushes and permanently delete all copies from all computers, servers, workstations, and network backups. Continued use of the assets following license revocation constitutes a direct, willful violation of international copyright law.

4.3. EVIDENCE SUBMISSION TO GATEWAYS:

RYGAARD CREATIONS Store rigorously monitors, tracks, and logs all transactional actions via Payhip's secure infrastructure. This includes, but is not limited to: purchase IP addresses, unique download tokens, download timestamps, geographic location data, browser user-agent details, and account creation metrics. In the event of a dispute or chargeback filing, this comprehensive metadata, alongside this signed policy and your proof of download, will be submitted directly to PayPal, Stripe, or your banking institution to actively overturn the chargeback and enforce the finality of the sale.

4.4. BLACKLISTING AND LEGAL ACTIONS:

Fraudulent buyers and organizations will have their emails, domains, payment profiles, IP blocks, and corporate entities permanently blacklisted from our storefront and reported to global merchant anti-fraud networks. RYGAARD CREATIONS Store reserves the absolute right to pursue all available legal remedies for digital asset theft, breach of contract, and intellectual property infringement in the appropriate jurisdiction.

5 - ACKNOWLEDGEMENT AND ACCEPTANCE

5.1. MANIFESTATION OF CONSENT:

Our digital checkout system requires affirmative action to complete a transaction. You cannot bypass checkout or finalize a purchase on this storefront without implicitly or explicitly checking the terms of agreement and completing payment. Therefore, by completing your checkout process and submitting payment via PayPal or Stripe, you verify that you have read, understood, and unconditionally accepted this Refund Policy and the general EULA in its entirety.

5.2. SEVERABILITY:

If any provision of this Refund Policy is found to be unenforceable, contradictory, or invalid under applicable local consumer laws, that specific provision shall be modified or limited to the minimum extent necessary to comply with the law, and the remainder of this policy shall remain unaffected and in full force and effect.
